TERMS AND CONDITIONS OF ONLINE TICKET SALES 

 

1. DEFINITIONS

1.1. Lumina – Lumina limited liability company with its registered office in Bielany Wrocławskie, ul. Błękitna 3, 55-040 Bielany Wrocławskie, entered into the Register of Entrepreneurs kept by the District Court for Wrocław-Fabryczna, VI Commercial Division of the National Court Register under no. 0000635401, tax identification number NIP 8982223934, REGON 365339997.
Lumina can be contacted daily from 16:00 to 21:00 at: kontakt@luminapark.pl.
1.2. “Terms and Conditions” – these Terms and Conditions of online ticket sales for Events organized by Lumina in the territory of the Republic of Poland.
1.3. “System” – iKSORIS, the ticket sales system via the website.
1.4. “Website” – the website available at bilety.luminapark.pl, used for ticket sales through the System.
1.5. “Purchaser” – any person using the System: a natural person (consumer), business entity, or other organizational unit making a purchase.
1.6. “Event” – a temporary outdoor exhibition with light installations, organized by Lumina in several cities in Poland under the name Lumina Park, for which tickets can be purchased online using the System, in accordance with the Terms and Conditions.
1.7. “Ticket” – a bearer ticket entitling its holder to a single entry to a specific Event.
1.8. “Payment Page” – an encrypted website enabling payment for the Ticket. The payment provider is PayU S.A., ul. Grunwaldzka 186, 60-166 Poznań, NIP: 7792308495, REGON: 300523444, KRS: 0000274399, share capital: PLN 7,789,000 fully paid.


2. GENERAL PROVISIONS

2.1. These Terms and Conditions set out the rules for the online sale of Tickets by Lumina using the System.
2.2. The condition for purchasing Tickets using the System is to read and accept the Terms and Conditions. Acceptance of the Terms and Conditions constitutes a declaration of intent and creates legal obligations between the Purchaser and Lumina.
2.3. The Purchaser is obliged to use the System in accordance with the Terms and Conditions and applicable law.
2.4. Technical requirements necessary to cooperate with the System:
2.4.1. a computer or other mobile device with a web browser and Internet access,
2.4.2. an email account,
2.4.3. a bank account enabling online payments for purchased Tickets.


3. PLACING AN ORDER

3.1. An order is placed by performing the following steps on subsequent subpages of the System:
3.1.1. selecting the Event, type, and number of Tickets,
3.1.2. correctly completing the mandatory fields of the order form or creating a User account,
3.1.3. checking the correctness of the entered data and order details (at this stage, among others, the number and type of Tickets, their total price including VAT, and the date for which the tickets are purchased will be provided),
3.1.4. submitting a declaration of acceptance of the Terms and Conditions,
3.1.5. placing the order by clicking the option I BUY AND PAY,
3.1.6. proceeding to the Payment Page and then paying for the order, in accordance with point 4.
3.2. The Purchaser who placed the order will receive a notification of order creation at the email address provided.
3.3. Lumina reserves the right to set a limit on the number of Tickets available for organized Events on specific days and times.

 

4. PAYMENT AND ORDER PROCESSING

4.1. To complete the order, the Purchaser must pay for it within two hours of its creation. Failure to pay within this period will result in automatic cancellation of the order. In case of cancellation, the Purchaser will automatically receive an email notification of order cancellation.
4.2. The Purchaser makes the payment for the created order via the Payment Page.
4.3. Payment for one order must be made in full, in a single transaction.
4.4. Lumina is not liable for any consequences related to malfunctions of the bank indicated by the Purchaser during the payment process.
4.5. Lumina issues invoices at the Purchaser’s request, provided by selecting the option I want to receive a VAT invoice when placing the order and providing complete and correct data necessary for issuing the invoice. Invoices are issued after payment has been made.
4.6. By selecting the option I want to receive a VAT invoice, the Purchaser agrees to receive the invoice electronically at the indicated email address. Consent to electronic invoices does not exclude Lumina’s right to issue and send paper invoices.
4.7. Lumina is not responsible for the consequences of providing false or incorrect data necessary for issuing a VAT invoice.
4.8. The order is processed after receipt of payment confirmation from the PayU system.
4.9. Acceptance of payment and order processing will be confirmed by an automatically generated email from the System. The email sent to the Purchaser’s address will include the purchased Tickets saved as a PDF file.
4.10. Lumina is not responsible for the consequences of the Purchaser providing order details to third parties. Making the Ticket available to a third party carries the risk that the Ticket may be used by such person. Lumina honors the Ticket of the person who presents it first.
4.11. Lumina is not responsible for deletion or non-receipt of notifications by the Purchaser, or for the consequences of providing false or incorrect data in the order form, in particular providing an incorrect email address.


5. TICKETS

5.1. Ticket prices are determined by Lumina’s price list. Lumina publishes Ticket prices on its website: bilety.luminapark.pl.
5.2. Ticket prices, including reduced-price Tickets, are given in Polish zlotys and include VAT.
5.3. At the website: https://luminapark.pl/regulamin-parku/ Lumina publishes information on who is entitled to reduced-price Tickets.
5.4. The inability to purchase a Ticket through the System does not mean that tickets are unavailable at Lumina Park ticket offices.
5.5. The validity period is specified on the Ticket.
5.6. The Ticket must be presented to Lumina Park staff upon entry to the Event.
5.7. Persons who purchased reduced-price Tickets are required, on the day of the visit, to present documents entitling them to the discount together with the Tickets to Lumina staff.
5.8. Reduced-price Tickets presented without documents confirming entitlement to the discount will not be honored and are non-refundable.

 

6. PERSONAL DATA – INFORMATION CLAUSE

6.1. The controller of the data of persons purchasing Tickets is Lumina sp. z o.o., ul. Błękitna 3, 55-040 Bielany Wrocławskie, email: ado@luminapark.pl.
6.2. Personal data is processed for the purpose of providing the service: enabling the purchase of a Ticket for the Event, and depending on the situation or the Purchaser’s request: enabling the use of a reduced-price Ticket (by presenting a document entitling to a discount, which is not recorded in any way), issuing an invoice, handling complaints, pursuing claims or defending against claims, as well as fulfilling obligations resulting from legal provisions, in particular tax regulations. The legal basis is the performance of the ticket sales agreement (Article 6(1)(b) GDPR), compliance with legal obligations related to ticket sales (Article 6(1)(c) GDPR), and the legitimate interests of the controller (Article 6(1)(f) GDPR).
6.3. The recipients of personal data will be persons or entities authorized by the Controller or entrusted with data processing, in particular providers of accounting, IT, technical, legal services, persons checking Tickets, as well as entities authorized to receive data under the law.

The independent controller is the provider of online payments – PayU S.A., ul. Grunwaldzka 186, 60-166 Poznań, NIP: 7792308495, REGON: 300523444, KRS: 0000274399.

6.4. Your personal data will be processed for the duration of the Ticket purchase agreement, including the period of rights protection under the contract, performance of rights and obligations under the law, including tax regulations, and the limitation period for potential claims.
6.5. Your data will not be transferred to a third country or international organization.
6.6. Data subjects have the right of access, rectification, erasure, restriction of processing, data portability, objection to processing, and the right to lodge a complaint with the supervisory authority (President of the Office for Personal Data Protection) if the processing violates the law.
6.7. Personal data will not be subject to automated decision-making, including profiling.
6.8. Personal data is protected and processed in accordance with Regulation (EU) 2016/679 of 27 April 2016 (GDPR) and the Polish Personal Data Protection Act of 10 May 2018.
6.9. Information on data processing related to the use of cookies on the website is provided in the “Privacy Policy” available at: https://luminapark.pl/polityka-prywatnosci/.

 

7. COMPLAINTS

7.1. Lumina has a legal obligation to deliver products free of defects, in accordance with the Terms and Conditions.
7.2. The Purchaser has the right to submit a complaint regarding non-performance or improper performance of services by Lumina arising from the purchase and use of a Ticket.
7.3. All questions, comments, or complaints regarding the purchase and use of Tickets should be sent by email to kontakt@luminapark.pl or by registered mail to the address indicated in point 1.1.
7.4. In the complaint, the Purchaser should provide:
7.4.1. the order number concerned,
7.4.2. the reason for the complaint and a description of the situation,
7.4.3. first and last name,
7.4.4. email address,
7.4.5. telephone number,
7.4.6. Purchaser’s address – if the complaint is sent by registered mail (Lumina will send the response in the same form).
7.5. Complaints will be reviewed by Lumina within 14 days from receipt. If the complaint does not contain the elements specified in point 7.4, the Purchaser will be asked to complete it. The time for completion will not count toward the 14-day review period.
7.6. If the complaint is resolved in favor of the Customer, the refund will be made by transfer to the bank account indicated by the Purchaser.
7.7. Lumina is not liable for improperly submitted complaints, in particular for providing incorrect or false data by the Purchaser, which prevents proper review.

 

8. EXCLUSION OF WITHDRAWAL FROM THE AGREEMENT AND REFUNDS

8.1. Tickets purchased online for Events are non-refundable and cannot be exchanged for other tickets or other Event dates. Refunds are only possible if the Lumina Park is closed on the day for which the Ticket is valid. According to the Lumina Park Terms and Conditions, this may occur for safety reasons, due to weather conditions, or by decision of the Government of the Republic of Poland.
8.2. Pursuant to Article 38(1)(12) of the Consumer Rights Act of 30 May 2014, the Purchaser is not entitled to withdraw from the contract or request a refund of purchased Tickets. By purchasing a Ticket, the Purchaser declares that they have been informed of this.

 

9. ADDITIONAL PROVISIONS REGARDING THE USE OF ELECTRONIC SERVICES

9.1. The use of electronic services, including online sales, is associated with potential risks described in point 9.2.
9.2. Risks associated with electronic services include:
9.2.1. Malware: malicious software targeting the user (to obtain information) or the computer system (to damage it). This includes viruses, worms, exploits, trojans (spyware, ransomware, etc.).
9.2.2. Phishing: fraud aimed at obtaining confidential information, often by impersonating a trusted source.
9.2.3. Spam: unwanted emails that may contain undesirable or dangerous content.
9.2.4. System breaches due to user negligence (sharing login and password, failing to log out, sharing devices, using simple passwords).
9.3. To limit risks described above, we encourage checking the source of emails, verifying unusual content (preferably by phone at a number other than the one in the message), avoiding suspicious links and attachments, not making payments for unsolicited services or surcharges, and using antivirus software, firewalls, and regular software updates.
9.4. After purchasing a Ticket, Lumina Sp. z o.o. never asks for any additional payments for any reason.
9.5. Basic functions and purposes of software or data not forming part of the service of enabling online ticket purchase include: providing information on Park opening days and hours, securing user data, storing purchase history, handling complaints and refunds, analyzing sales and user preferences, and sending information, including marketing messages.

 

10. OTHER PROVISIONS

10.1. Lumina is not responsible for data transmission disruptions on the Purchaser’s connection during purchase.
10.2. Before visiting the Event, the Purchaser should check whether the selected Lumina Park will be open and what exhibitions will be available. Lumina publishes information about opening hours and temporary closures on its website: https://luminapark.pl/.
10.3. Lumina reserves the right to suspend or restrict online sales at any time, due to force majeure, number of Purchasers, weather conditions, safety concerns, technical problems, or legal regulations.
10.4. Lumina reserves the right to amend the Terms and Conditions if at least one of the following important reasons occurs:
10.4.1. changes in law within the scope covered by the Terms and Conditions,
10.4.2. the need to adapt Lumina’s activities to administrative or court decisions,
10.4.3. changes in the ticket purchasing method for technical reasons,
10.4.4. changes in services provided by PayU S.A.,
10.4.5. changes to Lumina’s contact details specified herein,
10.4.6. extension of services requiring separate regulation.
10.5. For matters not regulated by the Terms and Conditions, generally applicable law applies, in particular the Civil Code, GDPR, the Consumer Rights Act, the Telecommunications Law, and the Personal Data Protection Act.
10.6. Disputes not resolved amicably will be settled by common courts in Poland, unless otherwise required by law. Disputes with non-consumer Purchasers will be submitted to the court competent for Lumina’s registered office.
10.7. The choice of Polish law does not deprive Consumers of protection granted under laws that cannot be excluded by agreement.
10.8. Consumers may use out-of-court complaint and redress procedures provided by consumer organizations, including:
10.8.1. permanent consumer arbitration court (Article 37 of the Act on Trade Inspection),
10.8.2. provincial inspector of Trade Inspection for mediation,
10.8.3. district/municipal consumer ombudsman (free legal advice, representation).
10.9. Detailed information on out-of-court complaint and redress procedures is available at consumer ombudsman offices, social organizations for consumer protection, and at: https://www.uokik.gov.pl and https://www.rf.gov.pl.
10.10. These Terms and Conditions enter into force on 1 October 2025.
