Regulations

TERMS AND CONDITIONS 

1.1. Lumina Limited Liability Company, with its registered office at ul. Błękitna 3, 55-040 Bielany Wrocławskie, entered into the register of entrepreneurs kept by the District Court for Wrocław-Fabryczna, VI Commercial Division of the National Court Register under KRS number 0000635401, with Tax Identification Number (NIP) 898-222-39-34, and National Business Registry Number (REGON) 365339997.  

1.2. "Regulations" means the Regulations for the online sale of tickets in Lumina.

1.3. "System" means iKSORIS, a system for selling tickets through the website.

1.4. "Website" means the website www.bilety.luminapark.pl used to sell tickets through the System.

1.5. "Buyer" means any person using the System, both a natural person (consumer), a business entity, and any other organizational unit making a purchase.

1.6. "Event" means an exhibition or a group of exhibitions in Lumina for which common types of tickets apply, or individual events organized by Lumina for which Lumina decides to conduct online ticket sales.

1.7. "Ticket" means an admission ticket entitling the holder to visit specific Lumina exhibitions or participate in a specific event organized by Lumina.

1.8. "Payment Page" means the website administered by Lumina Limited Liability Company, with its registered office at ul. Błękitna 3, 55-040 Bielany Wrocławskie, entered into the register of entrepreneurs kept by the District Court for Wrocław-Fabryczna, VI Commercial Division of the National Court Register under KRS number 0000635401, with Tax Identification Number (NIP) 898-222-39-34, and National Business Registry Number (REGON) 365339997, and the online payment provider is PayU, ul. GRUNWALDZKA 186/---, 60-166 Poznań, Wielkopolskie, NIP: 7792308495, REGON: 300523444, KRS: 0000274399, Share capital: PLN 6,474,300.00 paid in full.  

 


2. GENERAL PROVISIONS

2.1. These Regulations define the rules for the online sale of tickets using the online sales System by Lumina.

2.2. A condition of using the System is to read and accept the Regulations. Acceptance of the Regulations constitutes a declaration of intent and creates legal obligations between the Buyer and Lumina.

2.3. The Buyer is obliged to use the System in a manner consistent with the Regulations and applicable law.

2.4. Technical requirements necessary for cooperation with the System: 2.4.1. a computer or other mobile device with a web browser and Internet access 2.4.2. an email address 2.4.3. a bank account with internet access


3. ORDER PLACEMENT

3.1. An order is placed by performing the following actions on subsequent subpages of the System:
3.1.1. selecting the Event, type, and quantity of Tickets
3.1.2. correctly filling in the mandatory fields of the Order Form or creating a User Account.
3.1.3. verifying the correctness of the entered data and order details
3.1.4. making a statement accepting the terms of the Regulations
3.1.5. placing an order by clicking on the BUY AND PAY option
3.1.6. proceeding to the Payment Page.

3.2. The Buyer who has placed an order will receive a notification to the specified email address about the creation of the order.

3.3. Lumina reserves the right to set a limit on the number of tickets available for organized events.

 

4. PAYMENT AND ORDER PROCESSING

4.1. Payment Obligation and Cancellation: The Buyer is obliged to pay for the order within two hours of its creation. Failure to pay within this time will result in the automatic cancellation of the order. In the event of order cancellation, the Buyer will automatically receive a notification of order cancellation to the email address provided.

4.2. Payment Method: The Buyer makes payment for the created order through the Payment Page.

4.3. Single Payment: Payment for a single order must be made in one transaction.

4.4. Bank-Related Issues: Lumina is not responsible for any consequences related to irregularities in the functioning of the bank indicated by the Buyer during the payment process.  

4.5. Invoices: Lumina issues invoices at the Buyer's request. To request an invoice, the Buyer must select the "I want to receive a VAT invoice" option during the order placement and provide complete and correct data necessary for its issuance. Invoices are issued after payment.

4.6. Electronic Invoices: By selecting the "I want to receive a VAT invoice" option, the Buyer agrees to receive the invoice electronically at the specified email address. This consent does not exclude Lumina's right to issue and send invoices in paper form.

4.7. Incorrect Invoice Data: Lumina is not responsible for the consequences of providing false or incorrect data necessary for issuing a VAT invoice by the Buyer.

4.8. Order Fulfillment: The order is fulfilled upon receipt of payment confirmation from the PayU system.

4.9. Order Confirmation and Ticket Delivery: The acceptance of payment and fulfillment of the order will be confirmed automatically by an email generated by the System. An email containing the purchased Tickets in PDF format will be sent to the email address provided by the Buyer.

4.10. Email Costs: The Buyer bears the costs of the connection to download the email, according to the rates of their operator.

4.11. Third-Party Use of Tickets: Lumina is not responsible for the consequences of providing order-related data to third parties by the Buyer. Sharing the Ticket with a third party entails the risk of that person using the Ticket. Lumina will honor the Ticket of the person who reports it first in such a case.

4.12. Notification Loss: Lumina is not responsible for the deletion or non-receipt of notifications received by the Buyer.


5. TICKETS

5.1. Ticket Pricing: Ticket prices are determined by Lumina's price list. Lumina publishes ticket prices on its website: www.bilety.luminapark.pl.

5.2. Currency: Ticket prices are listed in Polish złoty and include VAT.

5.3. Ticket Availability: The system allows you to purchase selected tickets from Lumina's price list.

5.4. Ticket Availability at Box Offices: The inability to purchase a ticket through the system does not mean that tickets are unavailable at Lumina's box offices.

5.5. Validity Period: The validity period is specified on the ticket.

5.6. Varying Validity Periods: The validity period for tickets purchased at box offices may differ from the validity period for tickets purchased through the system.

5.7. Ticket Validation: Tickets are validated by presenting them to a Lumina employee at the event entrance.

5.8. Reduced-Price Tickets: Persons who have purchased reduced-price tickets are required to present documents proving their entitlement to the discount to Lumina employees on the day of their visit, along with their tickets.

5.9. Missing Documentation: Reduced-price tickets presented without a document confirming the entitlement to the discount will not be honored and are non-refundable.

5.10. Reduced-Price Tickets Eligibility: Reduced-price tickets are available in accordance with Lumina's current price list.

 

6. PERSONAL DATA AND PRIVACY POLICY

1. Data Controller: The data controller is Lumina, a limited liability company with its registered office at ul. Błękitna 3, 55-040 Bielany Wrocławskie.

2. Data Protection Officer (DPO): You can contact our Data Protection Officer (DPO) via email at kontakt@luminapark.pl or by post at: 55-040 Ślęza, ul. Templariuszy 1.

3. Purpose of Data Processing: Your personal data is collected by us for the purpose of processing it to provide the service in accordance with the Regulations.

4. Data Recipients: Your personal data may be disclosed to:

  • Entities authorized to receive data under legal provisions, persons authorized by the data controller,
  • Entities to which the data controller entrusts the performance of activities that involve the processing of data.

5. Data Transfer: Your data will not be transferred to a third country or an international organization.

6. Data Retention Period: Personal data will be processed for a period of 5 years from the beginning of the year following the year in which the order was placed, as well as for the period necessary to fulfill the archiving obligation resulting from legal provisions.

7. Your Rights: You have the right to:

  • Access your personal data and have it rectified, erased, or restricted, as well as the right to data portability and the right to object. In such cases, please contact the Data Controller directly (kontakt@luminapark.pl)
  • Lodge a complaint with the supervisory authority for the protection of personal data, i.e., the President of the Personal Data Protection Office, if you consider that the processing of your data violates the provisions of the General Data Protection Regulation (GDPR).  
     

8. Automated Decision-Making: Your data will not be processed in an automated manner, including profiling.

9. Legal Basis: Personal data is protected and processed in accordance with the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR), and in accordance with the Act of 10 May 2018 on the protection of personal data (Journal of Laws of 2019, item 1781).  

10. Information Clause: The information clause regarding the processing of personal data will be sent to the Buyer along with notifications automatically sent by the System, to the email address provided during the completion of the Order Form or the creation of a User Account.

11. Liability: Lumina is not responsible for the consequences of providing false or incorrect data in the order form.

 

7. COMPLAINS

7.1. Contact for Inquiries and Complaints: Any questions, comments, or complaints regarding the purchase and fulfillment of Tickets should be sent by email to: kontakt@luminapark.pl.

7.2. Filing a Complaint: Complaints can be submitted no later than 14 days from the occurrence of the event that is the subject of the complaint. In the complaint, the Buyer should provide: 7.2.1. The order number to which the complaint relates, 7.2.2. The reason for the complaint, along with a description of the situation to which the complaint relates, 7.2.3. Name and surname, 7.2.4. Email address, 7.2.5. Telephone number.

7.3. Complaint Handling: Complaints will be considered by Lumina once within 14 days of their receipt, except in cases where the reason for the complaint lies with the payment operator PayU. In such cases, the complaint will be forwarded to the PayU payment operator and handled by them (the complaint handling time may be extended in such a case). The Buyer will be informed of the decision by return email.

7.4. Refund: If the complaint is resolved in favor of the Customer, they will be entitled to a refund of the amount paid. Refunds will be made by bank transfer to the account specified by the Buyer.

7.5. Liability: Lumina is not responsible for improperly filed complaints, in particular for providing incorrect or false data by the Buyer.

 

8. RETURNS

8.1 Tickets for exhibitions and other cultural events purchased online shall not be refunded or exchanged for other tickets or for another date of the event. In accordance with the Act of May 30, 2014 on consumer rights (i.e. Journal of Laws 2020, item 287). By purchasing a ticket, the Buyer declares that he has been informed that he is not entitled to withdraw from the contract and demand a refund of the value of the purchased tickets.


9. OTHER REGULATIONS

9.1. System Disruptions: Lumina is not responsible for any disruptions in data transmission during the purchase process, interruptions, or errors in the System's operation resulting from any causes beyond Lumina's control.

9.2. Data Loss: Lumina is not responsible for any messages or data lost or misplaced on the Internet due to causes beyond Lumina's control.

9.3. Operating Hours and Exhibitions: Before visiting Lumina, please check if Lumina is open to visitors on the selected day and which exhibitions are available for viewing. Lumina publishes information about opening hours and temporary closures of individual exhibitions on its website: www.bilety.luminapark.pl.

9.4. Sales Period: Lumina reserves the right to freely decide on the start and end times of online ticket sales for each Event.

9.5. Sales Suspension: Lumina reserves the right to suspend online sales at any time, for reasons of force majeure or technical issues, and in connection with an ongoing pandemic, ticket sales may be subject to other restrictions resulting from current legal regulations.

9.6. Amendment of Regulations: Lumina reserves the right to amend these Regulations.

9.7. Governing Law: In matters not regulated by these Regulations, the provisions of law shall apply, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR), the Civil Code, and the Act of 10 May 2018 on the protection of personal data (Journal of Laws of 2019, item 1781).
